"Some of this increasedoversight comes as the result of heightened consumer outcry against claimsdenials, underwriting issues and rescission policies that resulted ininvestigations that grabbed national attention this past year. But additionally, health plans are facing new coverage mandates and timelines that will requireextensive changes in how they do business."According to Leidl, the top five compliance challenges health plans must gear upto face in 2009 include the following: 1. Underwriting and Rescission Practices Over the past severalyears, five major California health plans were the subject of anintensive investigation that made headlines and resulted inmillions of dollars in fines and the reinstatement of thousandsof insureds. The health plans were charged with post-claimsunderwriting and improper rescission practices defined asretroactive cancellation of an individual's health insuranceafter medical claims are filed. Although not all of theCalifornia settlements are final, the problems exposed inCalifornia reveal the need for a greater understanding of andfocus on state rescission guidelines.

Congress now has joinedwith states, consumer watchdog groups and individual claimants toactively investigate and take action against health insurers whorevoke coverage retroactively 2. Mental Health Parity In October, 2008 Congress approvedlegislation designed to improve mental health benefits forinsureds in medium and large employer-sponsored group healthplans. The law, which becomes effective in 2010, requires payersand insurers that cover mental health treatment to offer benefitsno less comprehensive than those providedto chronic orcatastrophic medical conditions, such as cancer or diabetes. Privacy and Security Regulations In 2008 the Californiaexpansion of its privacy and security regulation (SB1386) waslandmark in that it was the first data security breach law to beapproved by a state legislature. The law requires businesses toprotect against and disclose any security breaches of personalinformation, medical data and health insurance information. Otherstates are expected to follow and seek passage in 2009 and 2010.Doctors must now protect against unauthorized viewing of patientrecords within the office as well as disclosure of information tooutside persons 4. Quality Assurance In 2007-2008, regulators heightened theirfocus on quality of care and services.

Health plans mustdemonstrate effective quality assurance mechanisms to ensure thatcare delivered to members meets professional standards ofpractice. A fair and reasonable grievance and appeals process andan effective peer review system are critical indicators."Today, with a national focus on healthcare reform, and greater demand forparity, quality and comprehensive services in health plan coverages, scrutiny ofhealth plan practices is sure to increase," added Leidl. "Even organizationswith strong compliance programs in place should consider reviewing and shoringup their processes and procedures to prevent unexpected problems."ABOUT MANAGED HEALTHCARE UNLIMITED:Managed Healthcare Unlimited is a leading organization providing expertise inhealth plan regulatory evaluation and compliance. For the second game in a row the Buccaneers have out-scored their opponent in the fourth quarter, against Green Bay it was eleven points put up by the Bucs to win the game 38-28 and against the Miami Dolphins the Bucs put up 14 fourth quarter points as Tampa tried to rally another come-back game with Freeman leading the offense.Despite throwing an interception, Freeman remained composed and allowed himself to bring some hope to the Buccaneer offense that before the half only had acquired 6 points by way of 2 field goals.Freeman ended the day 16/28 for 196 yards 1 TD and 1 interception passing with 36 yards off 7 attempts rushing. A very productive day when you consider the fact that Freeman connected with veteran Tight-end Kellen Winslow during the second half drive to end the day with 7 receptions for 102 yards. Kellen Winslow has become an accessible prime receiver with 35 receptions for 352 yards and 5 TDs on the season as the Buccaneers continue to try to find some sort of offensive break-through as they are now 1-8 on the season.Next week the Bucs will host the NFC South first place New Orleans Saints at Raymond James Stadium..
